The defendant had a shop that had been attacked by rioters. He made petrol bombs as he was worried by further attacks. The defendant was charged with possessing an explosive substance which gave arise to suspicion that he did not have a lawful purpose. His plea was self-defence. He was acquitted and the point of law was referred to by the court of Appeal.
