The Defendant was driving a farm vehicle which E owned. The vehicle was authorised for this. The Defendant had stopped and was waiting to turn when the Victim, a motorcyclist who was driving at approximately 80 mph, crashed into them. The vehicle was designed with spikes in the front and this meant that the Victim suffered catastrophic injuries. The Defendant was convicted of causing death by dangerous driving and E was convicted of procuring the offence. Both convictions were quashed as there was no dangerous driving, nor was the vehicle’s condition dangerous under the Act
