The Defendant who was a boy of 15 was sitting next to a 13 year old girl on a bus and he kept asking her to perform oral sex. He was charged with inciting a child under 14 to commit an act of gross indecency, under s 1(1) of the Indecency with Children Act 1960. He thought the girl was 14 or over. The magistrates rules that the offence was one of strict liability. The Defendant’s conviction was quashed on appeal.
