At first instance,Partridge published an ad offering for sale Branmblefinch hens and cocks. However these birds were protected therefore the defendant was prosecuted under the Protection of Birds Act 1954 for ‘offering for sale’ a wild bird. This is due to the initial advertisement of Bramble Finches for sale. The Divisional Court quashed his conviction, after Partridge appealed against his conviction.
