Harvey wanted to buy Facey’s farm and sent a telegram stating ‘will you sell me Bumper Hall? Telegraph lowest price’. Facey replied saying ‘Lowest price acceptable is £900’. The Farm was then sold to another person. Harvey argued that by replying to him he had then accepted this and sued.
