Dodds had offered to sell houses to Dickinson. The offer at hand was to remain open until 9 am on 12th of June. Dickinson intended to accept the offer but did not accept it at once. Berry a mutual acquaintance then told Dickinson that Dodds had withdrawn the offer and Dickinson then sent an acceptance. However when it was received the house was already sold. Dickinson therefore claimed unlawful revocation and furthermore breach of contract.
