The Defendant was in bed with a loaded sub-machine gun when the Police found him at 8 a.m. His story was that he had taken the gun from another man in the early hours of the morning (1 a.m.) as he said he was going to use it ‘to do some people some damage’. The Defendant was going to get his brother to hand the gun into the Police that morning. The Judge stated that the defence of duress was not available and the Defendant was convicted. He appealed this decision to the Court of Appeal and they quashed the conviction and the case was sent for retrial.
