Williams v Roffey Bros & Nicholls Contractors LTD[1990]

The Roffey Bros are builders whom were sub-contracted the carpentry on a number of flats they were building to Williams for £20,000. However during this Williams realised he had under quoted for the job and fell on financial difficulties. However due to the contract the Roffey Bros had with the client who owned all of the flats, there was a delay clause which meant that they would have to pay out. However the Roffey Bros then offered Williams a further 10,300 to complete the job and so he did. However when Williams completed the work and the Roffey Bros failed to pay the extra, his claim to the money was successful.
